Terms & Conditions
These Terms and Conditions (“Terms”) govern your use of the services provided by Moksa Women’s Fitness Centre (“Moksa,” “we,” “our,” or “us”). By becoming a member, using our facilities, or engaging in our programs, you agree to these Terms. Please read them carefully.
1. Membership Terms
• Eligibility: Membership is open to individuals aged 18 and above. Minors (aged 16-17) may join with parental or guardian consent.
• Membership Fees: All membership fees, including monthly, quarterly, and annual fees, are non-refundable. Fees must be paid in full before access is granted.
• Membership Renewal: Memberships automatically renew unless canceled before the renewal date. Renewal payments are non-refundable.
• Right to Refuse Service: Moksa reserves the right to deny or terminate memberships for non-compliance with these Terms, inappropriate conduct, or misuse of facilities.
2. Usage of Facilities
• Access & Conduct: Members must follow the rules and guidelines displayed in the facility. Failure to do so may result in suspension or termination of membership.
• Proper Attire: Members must wear appropriate gym attire and footwear for hygiene and safety reasons.
• Personal Belongings: Members are responsible for their belongings. Moksa is not liable for lost, stolen, or damaged items. Lockers are available but are for temporary use only.
• Health & Safety: Members are encouraged to consult a healthcare provider before engaging in any fitness activity. Participation is at the member’s own risk.
3. Class & Personal Training Sessions
• Class Booking: Group classes require prior booking due to limited capacity. Admission is on a first-come, first-served basis.
• Class Cancellation: Moksa reserves the right to cancel or reschedule classes due to unforeseen circumstances. Members will be notified of such changes in advance.
• Personal Training: Personal training sessions are by appointment only. Missed sessions without 24-hour notice will be forfeited. Personal training fees are non-refundable.
4. Payment Terms
• Payment Methods: We accept payments through cash, cards, and other digital payment methods.
• Refunds: Membership fees, class packages, and personal training fees are non-refundable. Refunds will only be granted in exceptional cases, such as long-term medical conditions (supported by medical documentation) or extended facility closure.
• Late Payments: Late payments may result in suspension of membership or access to services until payment is made.
5. Privacy and Data Protection
• Data Collection: We collect personal information such as name, contact details, health information, and payment details to provide better services.
• Data Use: Your personal information is used to manage memberships, process payments, and provide tailored fitness services.
• Data Security: We implement robust measures to protect your personal data. However, no system can guarantee complete security.

6. Health Disclaimer & Assumption of Risk
• Health Clearance: Members are advised to seek medical advice before participating in any fitness program. Participation in fitness activities is voluntary and at your own risk.
• Injury Waiver: By using our facilities, you agree that Moksa is not responsible for injuries, health conditions, or medical complications that arise during or after your participation.
• Facility Safety: Members must follow all safety instructions from trainers and facility signage to reduce injury risks.
7. Cancellation and Termination
• Member-Initiated Cancellation: Members may cancel their membership but will not be eligible for refunds for the unused portion of the membership term.
• Moksa-Initiated Termination: We reserve the right to terminate memberships for rule violations, inappropriate behavior, or actions that disrupt the experience of other members. No refunds will be provided for terminated memberships.
8. Facility Closure and Service Disruptions
• Unforeseen Closures: Moksa may temporarily close its facility for maintenance, emergencies, or government-mandated shutdowns.
• Member Compensation: If the closure exceeds a specific period, Moksa may offer extensions, credits, or other remedies, but this is at the management’s discretion.
9. Code of Conduct
To maintain a positive and respectful environment, members are expected to:
• Respect Others: Avoid disruptive behavior, bullying, or harassment of staff and fellow members.
• Follow Hygiene Protocols: Use towels, sanitize equipment after use, and maintain personal hygiene.
• Use Equipment Properly: Do not misuse or damage gym equipment. Report any equipment issues to the staff.
10. Liability and Indemnification
• Limitation of Liability: Moksa is not responsible for injuries, accidents, theft, or loss of personal belongings within the facility.
• Member Responsibility: Members are solely responsible for their well-being while using the facilities. Participation in fitness activities is at the member’s own risk.
• Indemnification: Members agree to indemnify and hold Moksa harmless from any claims, damages, or expenses arising from their use of the facility or breach of these Terms.
11. Changes to Terms & Conditions
Moksa reserves the right to update these Terms at any time. Any changes will be posted on official platforms. Continued use of services implies acceptance of updated Terms.
